Terms and conditions
The house rules of the website itself. Part A applies now; Part B covers ordering and only takes effect once we actually start selling.
These terms consist of two parts.
Part A covers the use of this website and applies from now on to everyone who visits the site.
Part B covers ordering, payment and delivery. It only takes effect once we actually sell the game through this site or through a crowdfunding campaign. As long as there is no ordering facility on the site, Part B does not yet apply.
Part A — Use of the website
1. Who we are
KISSIT B.V.
Dutch Chamber of Commerce (KvK) number: 73795836
E-mail: info@sdshunter.com
KISSIT B.V. is the publisher of the game SDS Hunter (in Dutch: VIB Jager) and of this website. In these terms we call ourselves "we", "us" or "our", and we call you "you".
2. What these terms cover
These terms apply to every visit to and every use of sdshunter.com, including the Dutch-language pages, and to all messages you send us through the forms on this site.
Alongside these terms, the Disclaimer, the Privacy statement, the Cookie policy and the Intellectual property page apply. If those documents conflict, the more specific document prevails.
By using the site you agree to these terms.
3. What this site is
This site is an information and promotional site about an educational family card game. Its content is general and educational in nature. The Disclaimer explains what that does and does not mean — please read it, especially the part about safety information: the game never replaces a product's label or safety data sheet.
4. Using the site
You may use this site to read, to learn, to share pages and to contact us. What we ask you not to do:
- overload, disrupt or attempt to break into the site or our systems;
- circumvent security measures, including the anti-spam measures on our forms;
- extract or copy the site by automated means (scraping, spiders, crawlers) other than by ordinary search engines for normal indexing;
- collect content from the site in order to build datasets or to train language or image models — see the Intellectual property page on this point in particular;
- copy, reproduce or commercially exploit content from the site beyond what is permitted on that page;
- use the forms for advertising, spam, chain messages or unlawful content;
- impersonate someone else or submit other people's details without their consent.
In case of misuse we may block access to the site or to the forms.
5. Forms, messages and feedback
The site has two forms: a contact and player-feedback form, and a request form for business use and personalised print runs. The following applies:
- You are responsible for what you submit and for its accuracy.
- A message sent through a form is a question or a request, not an agreement. An agreement only comes into being once we expressly confirm it in writing or by e-mail.
- Do not send us confidential or sensitive information through these forms. We handle what you send with care — see the Privacy statement — but we do not accept any duty of confidentiality in respect of it unless we agree that separately with you.
- Ideas, suggestions and player feedback. If you send us an idea, a suggested improvement or comments on the game, we may use it freely to improve the game and the site, without payment and without any obligation to credit you. You retain whatever rights you have in your own submission; in addition, you grant us a non-exclusive, worldwide, transferable and perpetual right to use what you submit. If you want to share something with us on different terms, contact us before sending it.
- We read and assess every submission, but we do not promise to reply to every message or to adopt any suggestion.
6. Availability, changes and links
We may change, extend or (partly) discontinue the site and its content at any time. We do not guarantee uninterrupted availability or error-free operation.
The site links to third-party websites in some places. We are not responsible for the content or policies of those sites.
7. Liability
We are not liable for damage arising from the use of this site, from its (temporary) unavailability, or from decisions you take based on the information on this site.
If, despite the above, we are nevertheless liable in connection with the use of the website, that liability is limited to direct damage and to a maximum of € 500 per event, with related events counting as a single event.
These limitations do not apply in the event of intent or deliberate recklessness on our part, in the event of death or personal injury, or in so far as mandatory law — including consumer law and product liability rules — provides otherwise. If you are acting as a consumer, your statutory rights remain fully intact.
8. Indemnity
If you use the site in breach of these terms or of the law, you indemnify us against third-party claims arising from that, including reasonable legal costs.
9. Privacy and cookies
How we handle personal data is set out in the Privacy statement. Which cookies and similar techniques we use is set out in the Cookie policy.
10. Complaints
Do you have a complaint about the site, the game or the way we have helped you? E-mail info@sdshunter.com with a clear description. We confirm receipt within 14 days and then tell you how and within what period we will handle the complaint.
11. Changes to these terms
We may amend these terms. The version shown on this page at the time of your visit is the version that applies; the version number and date are shown at the top. For an existing agreement with a consumer, amended terms only apply after acceptance or after we have informed you about them clearly in advance.
12. Governing law and disputes
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law designates another court. As a consumer you always retain the right to bring the dispute before the court of your own place of residence.
Part B — Ordering, payment and delivery
Please note: this part is not yet in force. Nothing is currently sold through sdshunter.com. As soon as we offer the game through this site or through a crowdfunding campaign, Part B will apply to those orders and we will say so clearly during the ordering process. For an order, the version of these terms shown on the site at the time of ordering applies; that version is also sent to you with the confirmation.
13. Offer and prices
- The offer on the site states clearly what you get, in which language and edition, and at what price.
- Prices are in euros and include VAT, unless stated otherwise. Shipping costs are shown separately before you complete your order.
- Obvious mistakes and clerical errors in the offer are not binding on us.
- An offer applies while stock lasts and for the stated period of validity.
14. The agreement
- The agreement comes into being when you complete your order and we confirm it by e-mail.
- With the confirmation we send you the order details, these terms and — if you are a consumer — information about your right of withdrawal and the model form set out in the annex.
- We may satisfy ourselves that you are able to meet your payment obligations and may refuse an order or attach additional conditions to it, stating our reasons.
15. Payment
- Payment is made using the payment methods shown at checkout.
- Please report any inaccuracies in the payment details you provide as soon as possible.
- If you fail to pay on time, we will first send you a free reminder allowing 14 days before we charge collection costs, calculated in accordance with the statutory scale.
16. Delivery and risk
- We deliver to the address you provide when ordering.
- We aim to deliver orders within 30 days, unless another period is agreed or stated. If we cannot, we will tell you in good time; you may then terminate the agreement at no cost and will be refunded in full within 14 days.
- Risk of damage or loss passes when you (or someone designated by you) take receipt of the parcel.
- If the parcel is damaged or something is missing, please report it within a reasonable period at info@sdshunter.com, with a photo if possible.
17. Consumers' right of withdrawal
- If you buy at a distance as a consumer, you may withdraw from the agreement within 14 days without giving reasons. That period starts on the day after you (or someone designated by you) received the product.
- Notify us of the withdrawal within that period by e-mail to info@sdshunter.com or using the model form in the annex. Any unambiguous statement is sufficient.
- After notifying us, return the product within 14 days. The direct cost of returning it is yours, unless we state otherwise.
- During the cooling-off period, handle the product and packaging with care. Only unpack it as far as necessary to assess whether you want to keep it. If you handle it beyond that, we may charge for the loss in value.
- We refund everything within 14 days of your notification, including the standard outbound shipping costs, but we may wait until we have received the product back or until you have demonstrated that you have returned it. We refund using the same payment method you used, unless you agree to another method.
- The right of withdrawal does not apply to products made to your specification or clearly personalised — for example a personalised business print run with your own logo or your own situation cards. We state this expressly before entering into such an agreement.
18. Conformity and guarantee
- We warrant that the product conforms to the agreement, to the specifications in the offer and to the statutory requirements applying at the time of delivery.
- As a consumer you have the statutory remedies in the event of non-conformity: repair, replacement, price reduction or termination. These terms do not restrict those rights.
- Playing cards and boxes are printed matter. Minor variations in colour, cutting line and gloss that are usual in printing do not count as defects.
- Wear and tear from normal play is not covered by any guarantee.
19. Crowdfunding
If you support the game through a crowdfunding campaign (such as Kickstarter), the rules of that platform apply in addition to these terms and prevail where they differ.
A pledge to a campaign is pre-financing of production, not an ordinary purchase from stock. This means the stated delivery date is an expectation and that delay is possible. We will inform backers in good time and as concretely as we can. In so far as mandatory consumer law applies to such a contribution, your rights under it remain intact.
20. Product safety
The game is intended for ages 14 and up and is not a toy within the meaning of European toy safety law. It is not suitable for children under 14. When selling, we provide the legally required safety and traceability information on the packaging and with the online offer, as European product safety rules prescribe, including the details of the responsible economic operator in the EU.
21. Complaints and dispute resolution for orders
Please report complaints about an order within a reasonable period after discovery at info@sdshunter.com. We will respond substantively within 14 days or tell you how much time we need.
If we cannot resolve it together, you may bring the dispute before the competent Dutch court or the court of your own place of residence. Consumers within the EU may also use whatever out-of-court dispute resolution options are available at that time; we will refer to these during the ordering process.
Annex — Model withdrawal form
Only complete and return this form if you wish to withdraw from the agreement.
